Terms & Conditions

Article 1 – Introductory Provisions

1.1. These Terms and Conditions (“Conditions”) govern the rights and obligations between J&E Limited s.r.o., IČO: 243 26 445, se sídlem Plzeňská 3352/156, Smíchov, 150 00 Praha 5, v obchodním rejstříku pod sp. zn.: C 439434, vedená u Městského soudu v Praze (“Provider”) and a natural person who is a consumer (“User”) in connection with the use of the service offered under the Chargeet brand, consisting of the temporary provision of a portable powerbank through a charging station (“Service”).

1.2 The Service enables the User to use a powerbank on a short-term basis for the purpose of charging electronic devices, based on time-limited access.

1.3 These Conditions are binding on every User from the moment of conclusion of the contract pursuant to Article 2.

1.4 The Provider is not a payment service provider. All payment transactions and the processing of personal data in connection with payments are handled by a third party – a technology supplier (“Supplier”).

Article 2 – Conclusion of Contract

2.1 The User initiates use of the Service by scanning the QR code located on the charging station.

2.2 After scanning the QR code, the User is redirected to the Supplier’s web interface, where they are required to register or log in using an email address or phone number.

2.3 Before commencing use of the Service, the User is required to confirm these Conditions.

2.4 The contract between the Provider and the User is concluded at the moment when:

a) successful payment authorisation occurs (the amount is blocked), and at the same time

b) the powerbank is physically released from the station.

2.5 By concluding the contract, the User confirms that they have read and agree to these Conditions, and further represents that they are at least 18 years of age, are fully legally competent, and are authorised to use the chosen payment instrument. The Provider is not liable for the use of the Service by persons who provide false confirmation of these requirements.

Article 3 – Description of Service

3.1 The Provider enables the User to temporarily use a powerbank through a self-service station.

3.2 The powerbank is intended exclusively for charging common electronic devices (e.g. mobile phones, tablets).

3.3 The User is obliged to return the powerbank to the same station from which it was taken. The station from which the powerbank was taken is identified at the time the rental commences. The Provider guarantees the availability of a free return slot at that station for the entire duration of the rental.

3.4 The Service is provided continuously; however, the availability of individual stations or powerbanks is not guaranteed.

3.5 The Provider reserves the right to temporarily limit or interrupt the provision of the Service due to maintenance, technical malfunction, or the intervention of a third party.

3.6. The User expressly agrees that the Provider may begin providing the Service immediately after conclusion of the contract, i.e. at the moment the powerbank is physically released from the station.

3.7 The User acknowledges that as a result of this consent they lose the right to withdraw from the contract under consumer protection legislation.

3.8 The User further acknowledges that the Service consists in the very act of making the powerbank accessible and the possibility of its immediate use, regardless of whether the User actually uses the powerbank.

3.9 The Service is intended only for persons over 18 years of age who are fully legally competent and authorised to use the chosen payment instrument.

Article 4 – Summary of Basic Service Conditions and User Information

4.1 The User acknowledges that:

a) the Service consists of the temporary provision of a powerbank for a fee dependent on the length of its use,

b) the price is charged in time intervals of 45 minutes, with each commenced interval charged as a full interval,

c) the price for individual intervals is charged automatically for the duration of the Service through the chosen payment instrument,

d) before the Service commences, an amount of CZK 299 is blocked on the User’s payment instrument as security in the event of non-return, loss or damage to the powerbank; for the purposes of this Article, damage means physical damage as a result of which the powerbank is no longer fit for further rental to other users, as assessed by the Provider,

e) the Service runs from the moment the powerbank is taken over until it is returned to the station,

f) in the event of non-return of the powerbank within 12 hours, the Provider is entitled to claim the amount corresponding to the Pre-authorisation of CZK 299,

g) the User is obliged to return the powerbank without undue delay after ceasing its use,

h) from the moment of conclusion of the contract within the meaning of these Conditions, the User does not have the right to withdraw within the period provided under consumer protection legislation,

i) the User acknowledges that the Service is provided on a one-off and immediate basis and that its nature does not allow for its return or cancellation after performance has commenced.

4.2 The User confirms that these basic pieces of information were provided to them before conclusion of the contract and that they understand them.

Article 5 – Price and Payment Conditions

5.1 The Service is provided for a fee, the amount of which is determined based on the length of use of the powerbank.

5.2 The price is charged in time intervals of 45 minutes (“Billing Interval”). Each commenced Billing Interval is considered as a full interval.

5.3 Before the Service commences, an amount of CZK 299 (“Pre-authorisation”) is blocked on the User’s payment instrument. This Pre-authorisation represents the maximum amount that may be charged to the User for the Service.

5.4 Upon return of the powerbank, the actual rental cost is calculated based on the total duration of use and deducted from the Pre-authorisation. The remaining balance is released back to the User in accordance with the conditions of their payment service provider.

5.5 In the event that the powerbank is not returned within 12 hours, the full Pre-authorisation amount of CZK 299 is retained as compensation for the device.

5.6 The price per Billing Interval (45 minutes) is stated in the Service’s web interface before the Service commences. The User is always informed of the current price before the contract is concluded.

5.7 The User acknowledges that the current price may vary depending on the specific station or location at which the Service is provided, and may change over time.

5.8 All payments are processed through the Supplier. The Provider does not accept or hold the User’s funds.

Article 6 – Rules of Use and User Liability

6.1 The User is obliged to use the powerbank properly, in accordance with its intended purpose and these Conditions.

6.2 The User must not in particular:

a) disassemble, modify or otherwise interfere with the powerbank,

b) use the powerbank in a manner that may lead to its damage, overheating or destruction,

c) use the powerbank for any purpose other than charging common electronic devices,

d) transfer the powerbank to a third party without the consent of the Provider,

e) use or otherwise handle the powerbank in any manner that may cause damage to it or pose a risk to persons or property.

6.3 The User is obliged to return the powerbank to the same station from which it was taken, without undue delay after ceasing its use.

6.4 The User bears full responsibility for the powerbank from the moment of taking it over until its proper return.

6.5 The User is liable for damage caused by:

a) loss of the powerbank,

b) its damage,

c) its destruction.

6.6 The User is obliged to take reasonable measures to protect the powerbank against loss, theft or damage.

Article 7 – Provider Liability

7.1 The Provider warrants that the powerbanks are fit for ordinary use.

7.2 The Provider is not liable for:

a) the compatibility of the powerbank with a specific device of the User,

b) charging speed or achieved charging capacity,

c) damage arising from improper use of the powerbank by the User,

d) damage to the User’s electronic devices arising from the use of the powerbank, where the powerbank was functioning within its normal technical parameters at the time of use.

7.3 The Provider is not liable for temporary unavailability of the Service.

7.4 The Provider is not liable for any interruption or limitation of the Service caused by circumstances beyond its reasonable control, including in particular technical failures of third-party systems, network outages, power failures or other extraordinary circumstances. The Provider will restore the Service as quickly as is reasonably possible.

7.5. The Provider is not liable for indirect damages, lost profit or other consequential damages.

7.6 The Provider’s total liability to the User arising from or in connection with the Service, whether in contract, tort or otherwise, is limited to the greater of the following amounts:

a) the total amount paid by the User for the specific rental giving rise to the claim, or

b) the amount corresponding to the Pre-authorisation of CZK 299.

This limitation of liability applies to the fullest extent permitted by the laws of the Czech Republic and does not apply to liability for personal injury, death or any other liability that cannot be excluded or limited under applicable law.

7.7 The Provider does not guarantee uninterrupted availability of payment processing. The Provider is not liable for any delay in the release of the Pre-authorisation, which is subject to processing by the User’s payment service provider.

7.8 The Provider is not liable for any inability to access the Service caused by a damaged, missing or unlawfully tampered QR code. If the User suspects that the QR code has been tampered with, they must not proceed with using the Service and must notify the Provider without undue delay.

Article 8 – Unauthorised Use and Misuse of Service

8.1 The User is obliged to protect their access credentials and payment instruments against misuse.

8.2 The Provider is not liable for the use of the Service in the event that it was used by a third party as a result of:

a) the User granting access to their account,

b) insufficient security of the User’s device,

c) misuse of the payment instrument, provided this did not occur on the side of the Provider.

8.3 The User is obliged to inform the Provider without undue delay of any suspicion of unauthorised use of the Service or their account.

8.4 The Provider is entitled, in the event of suspected misuse, to:

a) restrict or block access to the Service,

b) refuse further provision of the Service.

8.5 Where the Provider has reasonable grounds to believe that a report of unauthorised use of the Service is false or was made in bad faith, the Provider is entitled to reject such report and to hold the User responsible for all charges and obligations arising in connection with the relevant use of the Service, in particular in cases where:

a) the User claims unauthorised use of the Service in order to avoid payment for a Service that was actually used,

b) the User intentionally allows a third party to use the Service and subsequently claims that such use was unauthorised,

c) the User submits a false report of misuse of the Service in order to obtain an unauthorised refund.

Article 9 – Complaints and Rights from Defective Performance

9.1 The Provider warrants that the powerbank is fit for ordinary use at the time of handover.

9.2 In the event that the powerbank is not functional or exhibits defects, the User is entitled to refrain from using the Service and to return the powerbank to the station immediately.

9.3 If a defect manifests during use, the User is obliged to:

a) cease use of the powerbank, and

b) return the powerbank to the station without undue delay.

9.4 The User is entitled to submit a complaint without undue delay after discovering a defect, using the contact details stated in these Conditions.

9.5 In the event of a valid complaint, the User has the right to:

a) a proportionate reduction of the price corresponding to the period during which it was not possible to properly use the Service, or

b) a refund of the price for the Billing Interval in which the defect occurred, if the defect prevented proper use of the Service.

9.6 Complaint entitlements are assessed from the moment the User notifies the Provider of the defect in accordance with Article 9.4. The User is not entitled to any remedy in respect of any period during which they continued to use the powerbank after becoming aware of the defect without notifying the Provider, as such continued use is considered acceptance of the Service during that period. Where a complaint is upheld, the relevant amount will be refunded to the User’s payment instrument through the Supplier within 14 days of the complaint being upheld, subject to the processing times of the User’s payment service provider.

9.7 For the purposes of complaints, the very act of making the powerbank accessible to the User is already considered use of the Service.

9.8 The Provider is not liable for defects caused by:

a) improper or careless use of the powerbank,

b) use of an incompatible device,

c) circumstances beyond the control of the Provider.

9.9 The complaint will be handled without undue delay, no later than 30 days from the date of its submission, unless the parties agree otherwise.

Article 10 – Personal Data Protection

10.1 The Provider processes the User’s personal data to the extent necessary for the provision of the Service.

10.2 The processing of payment data and the technical provision of the Service is carried out by the Supplier acting as a personal data processor.

10.3 Detailed information on the processing of personal data is set out in a separate document entitled “Privacy Policy”, which is available within the Service’s web interface.

10.4 The Provider acts as the data controller in respect of all personal data collected in connection with the Service.

Article 11 – Final Provisions

11.1 These Conditions are governed by the laws of the Czech Republic.

11.2 In the event of a dispute between the Provider and a User who is a consumer, the User has the right to out-of-court dispute resolution through the Czech Trade Inspection Authority (www.coi.cz).

11.3 The Provider is entitled to unilaterally amend or supplement these Conditions. The new version of the Conditions takes effect at the moment of its publication.

11.4 Rights and obligations arising during the period of validity of the previous version of the Conditions are not affected by any such amendment.

11.5 If any provision of these Conditions is invalid or ineffective, this shall not affect the validity of the remaining provisions.


This is an English translation of the original Czech language Terms and Conditions. In the event of any discrepancy between this translation and the Czech original, the Czech original shall prevail.
